NW-20-30-04-W3 is a small peninsula that juts into Brightwater Creek Reservoir. It is owned by the Provincial Government (WSA). This is where the pump, gen set, trailer, and fuel tank are located. Access to, and use of, this land is granted in the Right-0f-Way Agreement.

Terms and Conditions of the tender are as follows:
1. Buyer’s offer will be itemized by legal description & any conditions of the offer must be clearly stated.
2. The highest, or any, offer will not necessarily be accepted.
3. The two farmland parcels, along with all irrigation equipment and improvements, must be sold together.
4. Buyer must provide the Seller’s Brokerage a cheque for a 10.0% deposit of the price being offered unless otherwise agreed.
5. Offers CANNOT be subject to financing. Buyer must include an acceptable Letter of Approved Credit from a recognized Canadian financial institution for the full amount of the purchase price offered.
6. Seller WILL NOT consider offers from undisclosed buyers.
7. The Buyer acknowledges that they must be in good standing with all municipal, provincial, federal, and governmental departments to be approved for the required permits, licences, and agreements.
8. Mineral titles for mineral commodities owned by the Seller are NOT INCLUDED.
9. Seller will be responsible for the property taxes on the property to 11:59 pm December 31, 2023.
10. COMPLETION DAY will depend on the Seller’s ability to connect the pump to the irrigation system and finalize construction works for project WSA E2/10647-A016. The Seller undertakes to complete this as soon as possible, but the timing will depend on the weather, road access, and ice break up. The anticipated COMPLETION DAY is April 30, 2024, BUT MAY VARY. Under the Water Security Agency’s (WSA) Approval to Construct Work the owner must have control of the land until such time the project is completed.
11. The Seller will ensure all irrigation equipment and improvements are operational and in normal working order. If a system test cannot be completed before the SALE COMPLETION DAY, $200,000 will be held back from the sale proceeds until such time as the test can be completed.
12. All offers must be received by Hammond Realty by 12:00 pm Monday, January 29, 2024 (deadline).
13. All offers received are to be left open until 12:00 pm Friday, February 2, 2024. All offers received will be addressed and responded to [i.e. accepted, rejected, or countered].
14. The Seller acknowledges and accepts that the listing broker WILL NOT inform or present the Seller with any offers received until after the date and time mentioned in Term 12. above.
